Terms of service
Last updated 19 August 2026. These terms govern your use of Kistkeep, in full.
1. Acceptance of these terms
By creating an account or using Kistkeep in any way, you agree to be bound by these Terms of Service and by our Privacy Policy, Cookie Policy, and Refund Policy, which are incorporated by reference. If you do not agree, please do not use Kistkeep.
2. Eligibility and your account
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create a Kistkeep account. You must provide accurate information when registering and keep it up to date.
You are responsible for keeping your login credentials, master passphrase, and recovery key secure, and for all activity that happens under your account. Tell us immediately at [email protected] if you suspect unauthorised access.
3. What Kistkeep is, and isn't
Kistkeep is a secure vault for organising documents, passwords, memories, notes, and instructions, and for granting controlled, conditional access to people you trust. It is a piece of software, not a professional service.
Kistkeep is not a solicitor, financial adviser, accountant, or estate planning service, and nothing in the app or on this website constitutes legal, financial, or tax advice. Templates and guides are starting points only. For anything with binding legal effect, such as a Will or Power of Attorney, you should consult a qualified solicitor.
4. Plans, billing, and free trial
Free, Plus, and Family plans, their storage allowances, and item limits are described in full on our Pricing page. Paid plans are billed in advance on a recurring monthly basis via Stripe, and renew automatically until cancelled.
Plus includes a 14-day free trial for new subscribers; no payment is taken during the trial, and you can cancel at any time before it ends with nothing charged. If you don't cancel, billing begins automatically when the trial ends.
Prices are shown in GBP and may include VAT where applicable. We will give you reasonable advance notice by email before any price increase takes effect on your existing subscription.
5. Cancellation and refunds
You can cancel a paid plan at any time from your account's billing settings; your access to paid features continues until the end of the billing period you've already paid for, and your account then reverts to the Free plan rather than being deleted.
Our full refund terms, including the statutory 14-day cooling-off period for online purchases and when it applies, are set out in our separate Refund Policy.
6. Storage limits and fair use
Each plan has a storage allowance and item limits as described on our Pricing page. If you exceed a limit, you may need to remove content, or purchase a storage add-on, or upgrade, before adding anything new. We reserve the right to apply reasonable rate limits to prevent abuse of shared infrastructure, such as automated bulk uploads that could affect service quality for other users.
7. Trusted contacts and release conditions
You are solely responsible for choosing your trusted contacts, deciding what access to grant each of them, and configuring any release conditions. Kistkeep is not responsible for a trusted contact's own conduct once access has been granted or released.
Release of any content always requires a human-reviewed report confirming that your account status has changed; we never release access on a timer alone, and we reserve the right to request reasonable supporting information before confirming a report.
8. Your content and our licence to host it
You retain full ownership of everything you upload or create in Kistkeep, documents, notes, messages, memories, and anything else. We claim no ownership over your content.
You grant Kistkeep a limited, non-exclusive licence to store, encrypt, back up, and process your content solely for the purpose of providing the service to you, and to the trusted contacts and under the conditions you configure. This licence ends when you delete the content or close your account, subject to standard backup-retention timelines.
9. Acceptable use
You agree not to: use Kistkeep to store or transmit unlawful content, including material that infringes someone else's rights; attempt to bypass, disable, or probe our security controls; access or attempt to access another user's account without authorisation; use automated means to scrape, extract, or bulk-download data from the service; or interfere with the service's normal operation for other users, for example through excessive automated requests.
We may suspend or terminate accounts that breach this section, with notice where practicable.
10. Intellectual property
The Kistkeep name, logo, brand, and the underlying software, design, and technology are our intellectual property (or licensed to us) and are protected by copyright, trademark, and other laws. Nothing in these terms grants you any right to use our branding except as necessary to use the service as intended.
11. Third-party services
Kistkeep integrates with select third-party services, such as Stripe for payment processing, to operate. Your use of any third-party service linked from or integrated with Kistkeep is also subject to that provider's own terms, which we encourage you to review.
12. Suspension and termination
You may close your account at any time from your account settings. We may suspend or terminate your account if you materially breach these terms, including the Acceptable Use section above, if required to do so by law, or if we discontinue the service, in which case our continuity commitment below applies.
On termination, your right to use the service ends immediately, though your data export rights and our data retention obligations under the Privacy Policy continue to apply.
13. Our continuity commitment
We know that services in this category have failed users before, sometimes taking their data with them. We commit to giving you the ability to export your data at any time your account is active. If Kistkeep were ever to cease operating, we commit to providing at least 90 days' advance notice by email and in-app, and a clear window to export your data, before any deletion takes place.
14. Disclaimers
Kistkeep is provided "as is" and "as available". While we take security, encryption, and reliability seriously and design the service accordingly, we do not warrant that the service will be uninterrupted, error-free, or completely secure against every conceivable threat, and no storage system can guarantee absolute prevention of all data loss.
As explained in our Security page, losing both your Passwords master passphrase and your one-time recovery key makes that vault unrecoverable, by design; this is a deliberate trade-off of genuine zero-knowledge encryption, not a service failure, and we cannot restore that content under any circumstances.
15. Limitation of liability
To the maximum extent permitted by law, Kistkeep's total liability to you for any claim arising from your use of the service is limited to the amount you paid us in the 12 months before the claim arose, and we are not liable for indirect, incidental, or consequential losses, such as lost profits or lost opportunities.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.
16. Indemnification
You agree to indemnify and hold Kistkeep harmless from claims, losses, or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of the service, or content you upload that infringes a third party's rights.
17. Changes to these terms
We may update these terms from time to time to reflect changes in the service or legal requirements. We'll notify you of material changes by email or in-app notice at least 14 days before they take effect. Continuing to use Kistkeep after that point means you accept the updated terms.
18. Governing law and disputes
These terms are governed by the law of Scotland, without prejudice to any mandatory consumer protections that apply in your own jurisdiction if you are a consumer based elsewhere. Both parties agree to first attempt to resolve any dispute informally by contacting [email protected] before pursuing formal proceedings.
